1. INTRODUCTION

These General Terms and Conditions (hereinafter referred to as “Advisor Terms”) apply to all advisors (hereinafter referred to as “You”, “Advisor” or “Reader”) who provide online advice and services through the Fay Spirits Platform and enables them to receive payment for their services.

Fay Spirits is an online platform offering intuitive spiritual insights, where Advisors provide advice, personalized readings, spiritual guidance or other services to interested Users/Seekers. These payable Services are accessible through the Fayspirits.com website’s Online Store at www.fayspirits.com/shop (hereinafter referred to as the “e-Shop”). Seekers can discover clarity, guidance and healing through Fay Spirits platform.

The domain name Fayspirits.com, the website (hereinafter referred to as the “Site”) and the registered brand name “Fay Spirits” are owned and operated by AL IDILIO STUDIO LTD. These Terms constitute a legally binding agreement made between You and AL IDILIO STUDIO LTD, a Cyprus law governed private limited liability company with registered address at 4, Parodos 49th street, 4152 Kato Polemidia, Limassol, Cyprus (hereinafter referred to as the “Fay Spirits” or “we”), regarding the services provided to you through the Site.

We reserve the right, in our sole discretion, to amend or modify these Advisor Terms for any underlying reason. Any changes will be communicated by updating the “Last updated” date of these documents, and it is your ongoing responsibility to periodically review these Terms and Conditions to remain informed of any updates. Unless otherwise specified by Fay Spirits, all modifications shall be effective upon publishing.

Please note that Advisors are required to be at least 18 years of age, or 21 depending on the jurisdiction and must be fully able and competent to agree to the terms, conditions, obligations, affirmations and warranties herein.

Our Terms and Conditions are governed by the following legal provisions / legislations / Directives (including but not limited to):

• E-Commerce Law L156(I)/2004 & Amendment Law L97(I)/2007;
• Consumer Protection Law of 2021 (Law. 112(I)/ 2021) on the 12th May 2021 adopting the provisions of Directive 2011/83/EU of the European Parliament and the Council on consumer rights;
• Directive 2011/83/EU of the European Parliament and of the Council.

The materials contained on our Site are secured by relevant copyright and trademark law. These User Terms document is also protected by copyright, using it other than on present Website – partially or wholly – is not permitted!

You agree that you have read, understood, and consent to be bound by all of these Advisor Terms, along with any applicable regulations and additional terms and conditions contained in our other policies and agreements that may apply to Advisors, including but not limited to our Privacy Policy.

3. DEFINITIONS

• Advisor/Reader: Individuals who provide online services on the Fay Spirits website, commonly designated as Advisors.
• Seeker/Registered User/Buyer: Visitors who sign up for the services of the Fay Spirits website.
• Guest: Visitors who enter and visit the Fay Spirits website without registering for the services of the Site.

 

4. SERVICES

Our services include Cartomancy, Numerology, Tarot Card Reading, Face Reading, Personality Reading, Dream Interpretation, Theta Healing, Dowsing Method, Family Constellation, Coffee Ground Reading. We are constantly adding and updating new services and products.

By purchasing any of our intuitive Reading services, You acknowledge and willingly grant permission for the Advisor/Reader to energetically connect, either on yourselves or on a third party, solely for the purpose of conducting the Reading.

Our services are offered for general entertainment, informational and spiritual insight purposes only. Any interpretations or answers provided by our Advisors are offered anonymously and should not be considered a substitute for the advice and counsel of a qualified professional.

Reading does not predict specific outcomes; rather, it reflects the energy present at the time of the Reading. It is not intended as a tool for diagnosing health issues and is not intended as such. Tarot and numerology should not be considered as substitutes for psychological counselling, or any other form of therapy, or medical advice. Users engaging in this service acknowledge that it provides personal insight, and while Advisors will always exert their best professional efforts and skills, the outcome of Readings and the interpretations of Advisors are not guaranteed. Decisions made based on Reading are at the individual’s discretion.

Our Advisors are skilled and experienced. However, the use of our service by Seekers is at their own risk. Neither Fay Spirits nor any party involved in delivering the service is liable for any direct, incidental, consequential, indirect or punitive damages resulting from accessing, using, or interpreting of the services provided through Fay Spirits.

Fay Spirits does not facilitate direct communication between Users and Advisors. We do not provide Advisors with Users’ personal information, such as their phone numbers, location, or e-mail addresses. However, we may forward details such as your name, date of birth, gender and/or any other mandatory fields required to facilitate the Service

 

5. BECOMING AN ADVISOR

To become an Advisor, you must fill out our Online Application Form and submit it to us. This form requires your legal name, country of residence, e-mail address and telephone number for identification and contact purposes. Additionally, include a photograph of yourself, URLs to your website or social profiles and provide profile information outlining the services you offer. If applicable to your services, you must provide your qualifications and licenses. You may also optionally upload your curriculum vitae (CV) in PDF format.

After we receive your online submission and review your Application Form, you will be notified whether you have been qualified as an Advisor. If selected, you will proceed to an online interview, during which you must demonstrate your skills and abilities. By submitting your application, you understand and agree that it is your responsibility to ensure that your application is appropriate, and that all information provided is true, complete, up-to-date, and accurately reflects your credentials.

By submitting an application as an Advisor, you are not bound to continue to continuously accept orders and provide Readings. You have the freedom to stop accepting orders for any period, for any reason or for no reason at all. However, it is important to fulfill outstanding orders and existing obligations.

If you are selected to be an Advisor, you will receive an e-mail notification from us. You will be asked to describe the products or services you wish to offer through the Fay Spirits platform. Additionally, you must provide us with your PayPal, Revolut or Stripe account information in order to receive payments through the service.

We recommend that you respond promptly to encourage repeat orders. If you anticipate being unavailable to fulfill orders, please notify us, and no new orders will be sent your way.

Keep in mind that our Users will have the opportunity to provide feedback, which may appear publicly on our Site. or be contacted via email to describe the quality of their experience.

 

6. INDEPENDENT CONTRACTOR

Advisors are considered independent contractors of Fay Spirits, and nothing in these Terms shall be construed to create any association, employee, agent, or representative relationship between an Advisor and Fay Spirits for any purpose.

As an Advisor, you have exclusive control over the manner and means of providing your advice, subject to certain prohibited actions outlined below. You are not authorized to enter into any contract on behalf of Fay Spirits, and you are not considered our employee under any circumstances. You represent and warrant that you have obtained any and all permissions required by law.

Advisors are prohibited from requesting Users’ personal contact information, and Users must not provide such details. However, Users may be contacted via email or phone to participate in questionnaires regarding their experience and the quality of service received.

 

7. ADVISOR FEES

All charges for interactions between Advisors and Users will be billed by Fay Spirits. As an Advisor, you will receive all payments for fulfilling your orders through PayPal, Stripe or Revolut payment gateways.

Advisors receive the net amount of the charge paid by the User after the deduction of all fees, which may include a minimum commission fee and any applicable payment processing or other administrative fees disclosed in advance.

Fay Spirits assesses a minimum commission fee of 20% for each order. Any modifications to the fees will be communicated to Advisors in advance, and Fay Spirits will make reasonable efforts to provide notice in advance.

In the event that we receive a complaint regarding your service from a User, Fay Spirits reserves the sole discretion, for any reason, to withhold any amount due to you for completed orders.

Advisors will be paid on the first working day of each month, based on the number of fulfilled orders. Fay Spirits will make every effort to process payment to each Advisor’s chosen payment method for the amount based on the price published on the Site.

Fay Spirits shall not be liable for any miscalculations or malfunctions in processing payments. If you believe a mistake has occurred, you must submit a complaint to us within 15 calendar days of the payment in question. You hereby agree that any issues or disputes not raised within this 15-day period are waived and will not be considered by Fay Spirits.

 

8. GUIDELINES FOR ADVISORS

As an Advisor, you represent, warrant, and agree to the following:

• The information you submit in your Application Form is accurate and not false or misleading.
• You agree to accurately represent your skills, qualifications and background.
• Advisors are solely and fully liable for all services and advice provided.
• You will not engage in conduct that is harmful, unethical, fraudulent, deceptive, misleading, or offensive.
• You will not use inappropriate, vulgar, racist, offensive or obscene language.
• You will not exchange contact information with any User, or any other information which would allow you to interact with a User outside of the service, by incorporating it into your messages, e-mails, or reports. This includes, but is not limited to your telephone number, postal address, e-mail address, social media accounts, other sites where you offer services, or the name you are operating under on any of these sites.
• Any consultations and interpretations provided by Advisors are not substitutes for the advice and counsel of a qualified professionals, and they are not tools for diagnosing health issues. Therefore, you will not provide or attempt to provide any service or advice that you are not qualified to provide, including medical, healthcare or legal advice, or any other advice/information. Such advice may only be provided by a properly licensed psychologist, medical or legal professional, with an established physician-patient or attorney-client relationship.
• You may provide advice or information only for non-emergency matters. For emergency situations, you will instruct the User to immediately seek local emergency assistance.
• You understand and agree that if a User indicates potential self-harm or suicidal thoughts, you will advise them to seek immediate professional medical care provided by a properly licensed medical professional.
• You will not attempt to send spam, junk, or any other form of unsolicited e-mails or communications to Fay Spirits servers, nor transmit software viruses, worms, or any other malicious components.
• You will take all necessary measures to safeguard and not disclose any and all confidential information provided to you by Users.
• You are prohibited to be on under the influence of alcoholic and or narcotic substance during providing the service to the User.
• You are responsible to ask the User if they are under the influence of alcoholic and/or narcotic substance, if they are pregnant and if they are in psychiatric treatment and should the User fall in the above mentioned, immediate termination of the Service is required.

 

9. PRIVACY & CONFIDENTIALITY

Advisors agree to the terms of our Privacy Policy.

All information disclosed to you as an Advisor by us from a User must be treated as private and confidential. This information should not be shared, posted, or disclosed to any person, group, publication, forum, website, or any other place whatsoever.

 

10. TAX COMPLIANCE

As an independent contractor, each Advisor shall be independently and solely responsible for any income tax or other applicable taxes that the Advisor may be or become obligated to pay by virtue of receiving any fees or other remuneration.

According to this, Advisors are solely responsible for reporting, paying, and filing any and all income taxes, and associated documents related to any compensation received through providing services via Fay Spirits.

Fay Spirits shall not be responsible for paying any payroll, social security, or other taxes in any applicable jurisdiction, nor for making any insurance contributions.

 

11. ADVISOR DISCIPLINE

In the event that you, as an Advisor, violate any of these Advisor Terms, the Terms and Conditions contained in our other policies, or fail to fulfill User orders, Fay Spirits retains sole discretion to either terminate your Advisor status or take any other action we deem appropriate.

If, for any reason, you deactivate your availability, you are still responsible for delivering any pending orders on time that were initiated prior to the change in status.

 

12. LIMITATION OF LIABILITY

Under no circumstances shall Fay Spirits be liable to any Advisor for any indirect, incidental, consequential, or special damages (including but not limited to loss of business, revenue, profits, use, data or other intangible losses), regardless of how they arise, whether in action of contract, negligence, or other illegal action, or arising from the services or any provision of this agreement.

Fay Spirits is not responsible for any loss, including personal injury or death, resulting from anyone’s use of the service, any content transmitted to Users, or any interactions between Users of the service.

 

13. GOVERNING LAW

This Site originates from Cyprus. These General Terms and Conditions, as well as your use of the Site, are governed by and interpreted in accordance with the laws of the Republic of Cyprus applicable to agreements made and to be entirely performed within the Republic of Cyprus. Any legal action of whatever nature brought by either you or us shall be exclusively commenced or prosecuted in the courts located in the Republic of Cyprus.
