1. INTRODUCTION

These General Terms and Conditions (hereinafter referred to as “User Terms”) apply to all users (hereinafter referred to as “You”, “User”, “Guest”, “Seeker” or “Registered User”) who access the Fay Spirits Platform.

Fay Spirits is an online platform with intuitive, spiritual insights that allows Users to order personalized Readings, spiritual guidance as digital products or to purchase physical products and other digital services. Services are available on the Fayspirits.com website’s Online Store at www.fayspirits.com/shop/ (hereinafter referred to as the “e-Shop”). You can find clarity, guidance and healing.

The Fayspirits.com domain name, website (hereinafter referred to as the “Site”) and “Fay Spirits” as a registered brand name is owned and operated by AL IDILIO STUDIO LTD. These Terms constitute a legally binding agreement made between You and AL IDILIO STUDIO LTD, a Cyprus law governed private limited liability company with registered address at 4, Parodos 49th street, 4152 Kato Polemidia, Limassol, Cyprus (hereinafter referred to as the “Fay Spirits” or “we”), concerning your access to and use of the Site.

We reserve the right, in our sole discretion, to make changes or modifications to these User Terms at any time. You will be notified about any changes by updating the “Last Updated” date of this document and you have the ongoing responsibility to periodically review these User Terms to stay informed of any updates. Unless otherwise specified by Fay Spirits, all modifications shall be effective upon publishing.

Please note that this Site is designated for Users who are at least 18 years of age or 21 depending on the jurisdiction and are fully able and competent to enter into the terms, conditions, obligations and warranties herein.

By creating an account or otherwise accessing this Site and using the services, you agree that you have read, understood, and consent to be bound by all of these User Terms along with any additional terms and conditions contained in our other policies that apply to Users and their use of the service to which they must read and agree to prior to using the service, including but not limited to our Privacy Policy.

Our User Terms and Conditions are governed by the following legal provisions / legislations / directives (including but not limited to):

• E-Commerce Law L156(I)/2004 & Amendment Law L97(I)/2007;
• Consumer Protection Law of 2021 (Law. 112(I)/ 2021) on the 12th May 2021 adopting the provisions of Directive 2011/83/EU of the European Parliament and the Council on consumer rights;
• Directive 2011/83/EU of the European Parliament and of the Council.

The materials contained on our Site are secured by relevant copyright and trademark law. This User Terms document is also protected by copyright, using it other than on present Website – partially or wholly – is not permitted!

3. DEFINITIONS

• Seeker/Registered User/Buyer: the visitor who signs up to the services of the Fay Spirits website.
• Guest: the visitor who enters on and visits the Fay Spirits website without registering to the services of the Site.
• Advisor/Reader: the online services provided on the Website is rendered by individuals, who are commonly designated as Advisors.

 

4. SERVICES

Our services include Cartomancy, Numerology, Tarot Card Reading, Face Reading, Personality Reading, Dream Interpretation, Theta Healing, Dowsing Method, Family Constellation, Coffee Ground Reading. We are constantly adding and updating new services and products.

By purchasing any of our intuitive Reading services, You acknowledge and willingly grant permission for the Advisor/Reader to energetically connect, either on yourselves or on a third party, solely for the purpose of conducting the Reading.

Prior to selecting the service intended, please check the detailed product/service description, price, and means of payment – established for such services. The content provides you with essential information about the process, duration and scope of a service. This information is available on the Site.

Always take a moment to read the Portrait Photo and/or Coffee Ground Photo Guidelines to verify that your attached photos comply with the requirements, ensuring precise and accurate Readings.

Fay Spirits does not facilitate direct communication between Users and Advisors. After paying for the service, any content or information that you send, transmit through the Site, Fay Spirits will disclose it to an available Advisor. We do not provide the Advisors with your personal information, such as your e-mail address, location, or phone number. However, we may forward details such as your name, date of birth, gender and/or any other mandatory fields required to facilitate the Service.

Our services are offered for general entertainment, informational and spiritual insight purposes only. Any interpretations or answers provided by our Advisors are offered anonymously and should not be considered a substitute for the advice and counsel of a qualified professional.

Reading does not predict specific outcomes; rather, it reflects the energy present at the time of the Reading. It is not intended as a tool for diagnosing health issues and is not intended as such. Tarot and numerology should not be considered as substitutes for psychological counselling, or any other form of therapy, or medical advice. Users engaging in this service acknowledge that it provides personal insight, and while Advisors will always exert their best professional efforts and skills, the outcome of Readings and the interpretations of Advisors are not guaranteed. Decisions made based on Reading are at the individual’s discretion. By using this service, you agree to these Terms.

Our Advisors/Readers are skilled and experienced. However, the use of our service by Seekers is at their own risk. Neither Fay Spirits nor any party involved in delivering the service is liable for any direct, incidental, consequential, indirect or punitive damages arising out of the access to, use of, or interpretation of the services provided through Fay Spirits.

We prohibit you from disclosing personal contact information to Advisors, for example incorporating them into your message, including but is not limited to phone numbers, addresses and e-mail addresses. If you provide contact information to an Advisor, you do so at your own risk and may result in the permanent termination of your account.

 

5. CONCLUSION OF CONTRACT

By placing an order in our e-Shop and completing payment for the service or product along with delivery costs, you are entering into an electronic contract with us. This agreement, based on these User Terms outlined here, is considered an electronic contract and is not deemed as a written contract. Therefore, it shall not be documented or accessed in paper form. The establishment of this contractual relationship will be authenticated through electronic retention of transactional data.

When you decide to register, and/or to use the features of our Site, you will share and/or we will collect some personal information about you. Please read carefully our Privacy Policy, which explains how we collect, use and share your personal information and the choices you have regarding the use of your personal data.

We are not responsible for the content, privacy practices and security policies of third parties, including other websites and their activities or services.

The present User Terms shall be in effect from the date a Guest accesses Fayspirits.com and/or a User registers on our Site, and shall remain in force until duly terminated by either party.

 

6. SITE REGISTRATION

When you create and open an account on our Site, you will be asked to provide a username or e-mail address along with a password. You are entirely responsible for maintaining the confidentiality of your password, username and any other security information related to your account. You will be fully responsible for all activities that occur under your account. Fay Spirits will not be liable for any loss you incur due to any breach of your account, whether with or without your knowledge. You may be held liable for any losses arising due to someone else’s use of your account or password.

 

7. RIGHT OF WITHDRAWAL

We hereby inform you that the right of withdrawal under Consumer Protection Law of 2021 (Law. 112(I)/ 2021), regarding the rules of contracts concluded between consumers and business operations, shall be granted only to customers who qualify as Consumers. According to the law, a “Consumer” is defined as any natural person acting for purposes which are outside his / her trade, business or profession. Any natural person who purchases, orders, receives, uses or makes use of goods, as well as any natural person who is the recipient of any commercial communication or offer relating to goods is considered as Consumer (hereinafter referred to as “Consumer”).

In accordance with the Directive 2011/83/EU of the European Parliament and of the Council, as well as with the Cyprus legislation referred above, consumers shall be entitled to withdraw from the contract without giving any reason within 14 (fourteen) calendar days starting from the date receiving the product, either personally or by a third person designated by you, other than the carrier. Furthermore, in case several products are delivered, the starting date shall be considered as the date of delivery of the last product.

In addition, you, as Consumer, shall be entitled to exercise your right of withdrawal before acquiring physical possession of the goods, i.e. during the period between the conclusion of the contract and the date of receiving the product.

You may exercise your right of withdrawal by sending an unequivocal statement of your intention to withdraw using our contact details and either via e-mail or letter sent via post. However, we recommend sending your letter by registered mail via post so that the date of posting can be credibly certified.

To indicate the intention of withdrawal, the consumer may use the Model Withdrawal form here. Alternatively, you can draft your own statement expressing your decision to withdraw from the contract.

Upon receiving your withdrawal notification, an email confirmation will be sent to you. In case of withdrawal, you shall return the ordered product to the address specified in this General Terms and Conditions without undue delay and in any case not later than 14 (fourteen) calendar days from the date of notifying us regarding your intention to withdraw. The deadline is met if the product is sent (posted or handed over to a courier) by you before the end of the 14-day deadline.

Please note that by registering on our Site and accepting these User Terms, the User expressively acknowledges that he/she is losing his/her right to any withdrawal/cancellation right regarding the supply of digital services, such as the various Readings. The above express consent is acquired in accordance with the above-mentioned Directive on Consumer Rights (2011/83/EC) of 25 October 2011, transposed in Cyprus by the Consumer Protection Law, which entered into force of 5 December 2021.

 

8. PROTECTION AGAINST MISUSE

By using our services, you understand and agree that the following behavior is strictly prohibited and/or illegal at any time while using the service:

• Using vulgar, obscene, racially, religious, or offensive language, bullying, hate speech or any form of abusive behavior in interactive areas of the Site or our social media platforms.
• Submitting, sharing, or endorsing in any way illegal, offensive content.
• Harassing, threatening, or embarrassing another User.
• Infringing a third-party right, including but not limited to any copyright, trademark, rights of publicity, or other intellectual proprietary rights.
• Impersonating or attempting to impersonate any person.
• Transmitting advertising, promotional material, or solicitations of goods or services, except where expressly permitted by Fay Spirits.
• Transmitting any software virus or other malicious, harmful, or disruptive component.
• Sending any junk mail, spam, or unsolicited e-mail.
• Interfering or disrupting any Fay Spirits network in connection with the Platform.
• Engaging in any other conduct that would be considered a criminal offense, give rise to civil liability, or violate any law or regulation.
• Deliberately bypassing geographic restrictions to access content not intended for a User’s region.
• Invading the privacy of any other person.
• Being under the influence or using alcoholic and/or narcotic substances during the service provided
• Not communicating medication use, pregnancy condition, and mental condition.

You understand that if you cause or participate in any of the above-mentioned activities while using the service, your account will be terminated, and your actions may be reported to the proper authorities.

 

9. RIGHT OF MODIFICATION AND TERMINATION OF SERVICES

Fay Spirits may modify or discontinue, temporarily or permanently any service of the Platform, with or without notice to User without liability to User or any third party.

 

10. SITE REGISTRATION CANCELLATION

The registered Users have the option to cancel their registration account at any time on our Site.

If you want to cancel your registration and close your account, please locate the section “Account Deletion: Remove Your Presence from Our Platform” under the pages “User Account”, “Edit Account” or “Account Details” of your account and click on the button “Delete My Account”. Following the confirmation of your decision, your Registered Account will change to “Permanently Deleted” and we will erase your personal information stored in our system except as required by applicable law, our legitimate business interests, or any other permitted purpose as explained in our Privacy Policy.

 

11. PRIVACY

You are responsible for maintaining the confidentiality of your password, username, and any other security information related to your account. You are fully responsible for all activities that occur under your account.

By accessing and/or using the Platform, you agree to the terms of our Privacy Policy.

 

12. USER DISCIPLINE

The information you submit during your registration via the registration form and in any questionnaire must be valid and accurate. Users are fully and exclusively liable for any false declarations.

In case of a User’s unlawful conduct or breach of any term or condition contained herein or in our other policies, or violates any applicable rules, or if it is believed that the Registered User is under the age of 18 (or 21 in some jurisdictions), Fay Spirits reserves the right to immediately suspend the User’s account and permanently terminate it. Fay Spirits shall not be held responsible for any possible loss resulting from such termination, nor shall it provide any refunds.

 

13. LIMITATION OF LIABILITY

Under no circumstances shall Fay Spirits be liable to any User for any indirect, incidental, consequential, or special damages, regardless of how they arise, whether in contract, negligence, or any other illegal action, or arising out of the services or any provision of this agreement.

Fay Spirits is not responsible for any loss, including personal injury, miscarriage or death, resulting from the use of the service by anyone, any content transmitted to Users, or any interactions between Users of the service.

 

14. GOVERNING LAW

This Site originates from Cyprus. These General Terms and Conditions and your use of the Site are governed by and interpreted in accordance with the laws of Republic of Cyprus applicable to agreements made and to be entirely performed within the Republic of Cyprus. Any legal action of whatever nature brought by either you or us shall be exclusively commenced or prosecuted in the courts located in the Republic of Cyprus.
